Post Conviction Motions Per All Florida Criminal Rules

There are many different types of Florida post-conviction relief motions, and they are always being amended and updated. The common ones include:

  1. A motion to correct, reduce, or modify a sentence pursuant to Florida Rule of Criminal Procedure 3.800; or seeking jail credit for time spent in a Florida jail must file a motion under rule 3.801
  2. A motion to vacate, set aside, or correct a sentence pursuant to Florida Rule of Criminal Procedure 3.850; or 3.853 for post-conviction DNA testing.
