Federal Writ of Habeas Corpus Petitions

If you believe that your incarceration is unjustified, you need to look at every possible avenue for relief under both state and federal law. One of the options you may have is a federal writ of habeas corpus.

A writ of habeas corpus (Latin translation is “produce the body”) is essentially an order that requires the authorities to bring a prisoner to court. There, the authorities are then required to show that the prisoner’s detainment is lawful.

A writ of Habeas Corpus id frequently used to challenge situations where the condition of confinement amounts to cruel and unusual punishment. For example, a prisoner held in isolation without lawful reason may utilize this method to appeal their conditions. Similarly, someone who feels that their sentence was unfair due to the nature of their offense may also use a habeas corpus petition seeking judicial review.

Habeas corpus petitions are a distinct part of the post-conviction relief process. They are not the same as an appeal, but often used in conjunction with other appellate measures.

We recommend you contact one of our cooperating Florida licensed attorneys listed on this site, or have us conduct a Case Review that will be reviewed by one of these attorneys, to determine if you are entitled to relief through federal habeas litigation because of a violation of a United States constitutional right.

If you were convicted of a crime and believe that you are entitled to relief because of unlawful detainment, please complete our Case Review to determine if meritorious grounds exist to proceed.
